Condo Document Review for Buyers

Condo-Check recognizes the risk of buying a condominium without first knowing the facts of the business component. As a condominium unit owner, wanting to sell your home can be simple and easy with the addition of a Condo-Check document review. Having the review prepared and available for your buyer and your Realtor at the point of listing the unit can save you time, stress and money. In the case where your home remains on the market for longer than you had hoped, we will update the report every three months, at no extra charge. Realtors' Information

Section 44 of the Condominium Property Act of Alberta allows the purchaser of a condominium, in Alberta, the right to request information (documents) in regards to the condominium corporation, before they buy.

Since a condominium unit (home) is part of a legal corporation, the buyer has the task of investigating the function and operation of that specific corporation before they buy. The only rights to that information is through a written request being supplied to the corporation, allowing 10 full business days for the corporation to provide the documentation that was requested. The written request is typically part of the Real Estate Purchase Contract, with a time allowance for review of the documents, as a condition.

The buyer has the right to rely on the Realtor to be competent in protecting their rights as a buyer and to access the documentation they need to make an informed buying decision. What this means is that it is assumed that the Realtor writes the contract and is dutiful in representing their clients’ best interests by obtaining all information available to the buyer under the Act, and then allows appropriate time to review these documents, before waiving the condition.
